1. Definitions and Interpretation
1.1 In these Terms and Conditions (the “Agreement”), the following definitions apply:
“The Tranquillity”, “the Organisation”, “we”, “us” or “our” means The Tranquillity and its representatives, including but not limited to Nikki Dutta.
“Participant”, “Student”, “you” or “your” means any individual who enrols on, books, or pays for a course, programme, workshop, or related service offered by The Tranquillity.
“Programme” means any course, programme, workshop, class series, or related educational or spiritual offering delivered by The Tranquillity, whether in person or online.
“Fees” means all sums payable by the Participant in connection with a Programme, whether paid as a deposit, an instalment, or in full.
1.2 Headings are for convenience only and do not affect interpretation.
2. Formation of Agreement
2.1 By making any payment toward a Programme, whether a deposit, an instalment, or payment in full, the Participant confirms that they have read, understood, and agreed to be bound by this Agreement in its entirety.
2.2 This Agreement takes effect from the date on which the first payment is received by The Tranquillity.
3. Fees and Payment
3.1 Payment of any Fees, whether in part or in full, reserves and confirms the Participant’s place on the Programme, to the exclusion of other prospective participants.
3.2 Payments are to be made primarily by bank transfer. A Participant’s place is confirmed only once the relevant Fees have cleared in full into the receiver’s account.
3.3 Where a Participant makes payment from outside the United Kingdom, any bank charges, transfer fees, or currency conversion costs incurred in sending payment are the sole responsibility of the Participant, and will not be deducted from or offset against the Fees owed.
3.4 The Tranquillity may, at its discretion, offer an instalment payment plan. Where such a plan is agreed, continued participation in the Programme is conditional upon each instalment being paid in full by its due date. Failure to pay any instalment by its due date will be treated as voluntary withdrawal by the Participant under Clause 4, and no sums already paid will be refunded.
4. Cancellation and Refunds
4.1 All Fees paid to The Tranquillity, whether as a deposit, an instalment, or in full, are non-refundable. This applies regardless of the reason for withdrawal and regardless of whether withdrawal occurs before the Programme commences or at any point thereafter.
4.2 Voluntary withdrawal means any decision by the Participant to discontinue, step back from, or fail to complete a Programme, for any reason whatsoever, including but not limited to a change of personal circumstance, a change of mind, or a scheduling conflict.
4.3 No Fees, once paid, are transferable to another individual, to a different Programme, or to any other service offered by The Tranquillity. 4.4 A Participant may raise any concern regarding payment by writing to team@thetranquillity.co.uk. The Tranquillity will consider and respond to all such correspondence. For the avoidance of doubt, the policy set out in Clause 4.1 is not affected by such correspondence, and no refund will be issued as a result of it.
4.5 Where The Tranquillity, at its sole discretion and on the recommendation of Nikki Dutta acting in her professional capacity, requires a Participant to step back from a Programme on grounds relating to that Participant’s wellbeing or suitability for the Programme, any refund in such circumstances is entirely at The Tranquillity’s discretion, is not automatic, and is not guaranteed. This Clause 4.5 does not affect the position set out in Clause 4.1 in respect of voluntary withdrawal by the Participant.
5. Suitability for Participation
5.1 These Programmes are open to beginners and experienced students alike, and no prior qualificationis required to enrol.
5.2 The Programmes involve inner, reflective, and at times energetic work, and Participants should expect and accept that this process may involve fluctuation and variation in emotional experience over its course.
5.3 If a Participant is currently managing a mental health condition, or has a history that may be relevant to this kind of work, they are asked to disclose this to team@thetranquillity.co.uk prior to or at enrolment, so that suitability and any appropriate support can be discussed. This request is made for the purpose of participant welfare and does not itself operate to exclude any Participant from enrolment.
5.4 These Programmes are educational and spiritual in nature and do not constitute, and are not a substitute for, medical or psychiatric treatment. Any Participant currently receiving medical or psychiatric care is advised to continue that care in parallel with, and not in place of, participation in a Programme.
6. Code of Conduct
6.1 All Participants are to conduct themselves with courtesy and respect toward other Participants and toward The Tranquillity’s representatives at all times, including within any class, group forum, or othercommunication channel associated with a Programme.
6.2 Participants are asked not to seek out or initiate extended personal engagement with other Participants beyond what the Programme itself requires, save where such engagement is welcomed on a mutual basis.
6.3 The Tranquillity’s representatives, including Nikki Dutta, will conduct themselves toward every Participant with the same standard of respect required of Participants under Clause 6.1, and will not mock, ridicule, or demean any Participant.
6.4 Group forums operated via WhatsApp, Telegram, or similar platforms are provided solely for purposes connected with the Programme, including homework, course materials, and related discussion.
6.5 The Tranquillity reserves the right, at its sole discretion, to remove any Participant from a Programme for breach of this Code of Conduct. No refund will be issued in such circumstances.
7. Scheduling and Delivery
7.1 The Tranquillity reserves the right to revise the date or time of any class or session. Where this occurs, an equivalent make-up session, or additionaltime, will be provided to Participants to compensate for the change.
7.2 Where a class is disrupted by illness, technical failure, or connectivity issues, The Tranquillity will extend the session, arrange an alternative date, or provide additional time in a future class, to ensure Participants are not disadvantaged.
7.3 Adjustments under this Clause 7 may be communicated to and discussed with the Programme group as they arise and do not require advance formal notice.
8. Private Sessions
8.1 Where a Programme includes allocated one-toone sessions, these will be released for booking during the course of the Programme in accordance with the relevant curriculum.
8.2 Once a date and time for a private session has been agreed, a Participant’s non-attendance or late cancellation will be treated as use of that allocated session, save where The Tranquillity, at its discretion, determines that extenuating circumstances (such as bereavement or serious illness) apply.
9. Technical Requirements
9.1 Participants are responsible for ensuring reliable access to email and internet connectivity sufficient to participate in the online elements of a Programme.
9A. Platforms
9A.1 Live sessions are generally delivered via Zoom, which does not require a paid or registered account to join. Some private sessions or communications may take place via Telegram, which requires a free account.
10. Recordings and Confidentiality
10.1 Mediumship demonstrations delivered as part of a Programme are live only. No recording of such demonstrations will be made available.
10.2 All Zoom sessions and webinars are provided exclusively for enrolled Participants and must not be recorded, shared, broadcast, or uploaded to any other platform by any Participant.
10.3 Where a Participant is unable to attend a live class, a recording of that class (excluding any mediumship demonstration) may be made available to that Participant only.
11. Intellectual Property
11.1 All course materials, scripts, recordings, and teachings provided as part of a Programme remain the intellectual property of Nikki Dutta and The Tranquillity.
11.2 Materials are licensed to the Participant for personal use only and must not be reproduced, taught onward, or shared with any third party without the prior written consent of The Tranquillity.
12. Force Majeure
12.1 In the event that Nikki Dutta’s ability to deliver a Programme is permanently interrupted, including by death, during the course of a Programme, this Agreement will terminate as between The Tranquillity and the Participant without further obligation on the part of Nikki Dutta’s estate or legal representatives.
13. Governing Law and Jurisdiction
13.1 This Agreement is governed by, and is to be construed in accordance with, the laws of England and Wales.
13.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with this Agreement.
14. Acceptance
14.1 By enrolling on and making payment toward a Programme, the Participant confirms that they have read, understood, and agree to be bound by this Agreement in full.
